TetNet Internet Promotion Inc.'s FREE DOMAIN REGISTRATION Terms and Conditions:

Placing your order confirms your acceptance of these terms.
The person or entity ordering this account will hereafter be referred to as "Client" and TetNet Internet Promotions Inc. as "TetNet".

1. TetNet FREE DOMAIN REGISTRATION offer applies only to .com, .org, and .net domain names. Offer is valid only for contracts and payments received prior to May 31, 2001.

2. The minimum contract length is 12 months for the TetNet FREE DOMAIN REGISTRATION offer. Subject to the provisions hereof, the account will be opened upon reception of contract and payment. The billable service period begins on the date the Client's site becomes available online. The Client's annual hosting on TetNet's servers will automatically be renewed for successive billable periods on the expiry of the initial term, unless the Client gives the TetNet notice in writing of its intention to terminate the subscription 30 days prior to the beginning of the next billable period. Should the Client fail to pay TetNet the hosting fee within 30 days, hosting will be automatically cancelled and the Client's web site files removed from TetNet servers.

3. Quality of Service. TetNet will make the best efforts to provide quality and uninterrupted service.

4. Limitation of Liability. TetNet will not be responsible for temporary interruptions of services due to technical upgrades or difficulties of the affiliated communications system(s). In such an event, TetNet will make every effort to restore service as soon as possible. TetNet will not be responsible for any damage suffered by the Client. This includes loss of data resulting from delays, non-deliveries or service interruptions caused by TetNet's negligence, the Client'S error or omissions or any communications difficulties outside of TetNet's control. The Client assumes full responsibility and risk of loss from the Client's downloading and/or use and/or uploading of the files from the Client's site. The Client agrees that in no event shall TetNet be liable for any damages, including without limitation, direct, indirect, incidental, special or consequential damages, or damages for loss of profits or revenue incurred by the Client or any third party, whether in an action in contract or tort, even if TetNet has been advised of the possibility of such damages. TetNet does not guarantee the privacy of any data, information, content or other materials transmitted by, to or through its computer and/or communications systems, or any part thereof, including, without limitation, TetNet's back-up materials.

5. Client agrees to protect and indemnify TetNet against any and all liability, loss, or expense arising from claims of libel, unfair competition, unfair trademarks, trade names or patents, violations of rights and privacy and infringement of copyrights and property resulting from Client's use of TetNet services.

6. Account information. Client agrees to keep his account information confidential. The Client agrees to be responsible for all use of Client services provided by TetNet. The Client agrees to promptly notify TetNet in writing of any unauthorized use of the Client's email(s), secure database, and/or FTP account(s) and to take such steps as are reasonably required to prevent its further occurrence.

7. Acceptable use of services. TetNet may only be used for lawful purposes. Transmission of any material in violation of any Federal, Provincial or local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. Further, the Client is not permitted to distribute material promoting hatred against individuals or groups or any content which may be deemed to be illegal according to the laws of Canada. The Client understands that TetNet's services are subject to immediate termination without compensation for non-compliance with the "Acceptable use policy" in Article (8) below. Further, Client will be responsible for the full amount of any tangible and intangible damages resulting from non-compliance with the "Acceptable use policy". TetNet reserves the right to change the "Acceptable use policy" from time to time to reflect the dynamic nature of the Internet. TetNet has the authority to define abusive conduct to the system and to have the authority to revoke Client's services without notice if deemed that Client's activities are abusive. TetNet reserves the right to suspend without prior notification, accounts which are deemed to be a threat to the functionality or existence of TetNet's hosting service.

8. Acceptable use policy. TetNet provides to business users several information technology related services, including such services as various electronic mail (e-mail) packages and services, World Wide Web hosting arrangements, and other online and Internet-related services. It is contrary to TetNet policy for any user of any of these services to effect or participate in any of the following activities through a TetNet-provided service:
    1. To send unsolicited e-mailings to e-mail users, if such unsolicited e-mailings could reasonably be expected to provoke complaints;
    2. To falsify user information provided to TetNet or to other users of the service in connection with use of a TetNet service;
    3. To engage in any of the foregoing activities by using the service of another provider, but channelling such activities through a TetNet account, re-mailer, or otherwise through a TetNet service or using a TetNet account as a mail-drop for responses or otherwise using the services of another provider for the purpose of facilitating the foregoing activities if such use of another party's service could reasonably be expected to adversely affect a TetNet service; and,
    4. To allow for organizations, businesses, or individuals other than the specific Client with whom TetNet has entered into signed agreement to have web pages contained within the Client's web site without written permission from TetNet.

9. Termination of Service. Hosting of the Client's web site by TetNet can be terminated by either the Client with written notice delivered by mail and received by TetNet 30 days prior to cancellation date. TetNet also reserves the right to cancel any services/account without notice for reasons it sees as fit and just. The annual or monthly hosting fee is non-refundable when cancellation of service is initiated by the Client or TetNet.

These Terms and Conditions supersede all previous representations understandings or agreements and shall prevail notwithstanding and variance with terms and conditions of any order.
